Ussha Harun, 49, the accused person, failed to attend court despite being served with a criminal summons.
The prosecution prayed the court to issue a bench warrant, stating that Harun had been served with a criminal summons but failed to honour it and had also not been cooperating with the Police.
The court granted the prosecution’s request and adjourned the case to March 12, 2026.
Mr Davies Essuman, the complainant, is a retired military officer, a resident of Gbawe and a power of attorney holder for Natalie Narki Nettey Marbell.
Harun, the accused person, is a building contractor and a resident of Spintex, both in the Greater Accra Region.
Prosecution said in 1995, Marbell acquired 0.290 acres of land at Adjiringanor in the Greater Accra Region and obtained a land title certificate.
In 2005, the complainant fenced the entire property and installed a gate with a security post.
A few weeks ago, the complainant received information that about 20 unknown persons had unlawfully broken into the property.
Upon confirming the information, the complainant reported the matter to the Accra Regional Police Command on January 13, 2026, for assistance.
Police investigations led to the apprehension of the accused person.
During investigations, the accused denied the offence but claimed the matter had already been investigated at the National Police Headquarters. However, further investigations proved otherwise.
Prosecution said the accused failed to submit relevant documents to assist with investigations despite several requests by the Police.
Investigations further revealed that the accused continued development on the land even after being advised by the police to desist from accessing the property, thereby interfering with investigations.
After investigations, the accused was charged and put before the court.
