The New Patriotic Party Minority Caucus in Parliament on Wednesday welcomed the Supreme Court’s decision to quash the Tamale High Court’s judgment annulling the 2024 Parliamentary election in Kpandai.
“The people of Kpandai have an MP who was duly elected, duly declared and gazetted, and now duly affirmed by the apex Court of the land,” said Mr Alexander Kwamena Afenyo-Markin, the Minority Leader.
A statement signed by Mr Afenyo-Markin, the Minority Leader, and copied to the Ghana News Agency said, “Their rights to representation have been restored and protected, and their will as expressed at the ballot box has been allowed to speak louder than procedural missteps and overreach.”
The Supreme Court on Wednesday, January 28, 2026, quashed the decision of the Tamale High Court that ordered the re-run of elections in Kpandai.
“In a 4-1 decision, with Justice Gabriel Pwamang dissenting, the order of certiorari granted by the Tamale High Court, Commercial Division, dated November 24, 2025, be quashed. All consequential orders are equally quashed,” the court added.
The court has set Friday, February 6, 2026, to deliver its full reasons for its decision.
According to the statement, the Supreme Court’s ruling had also allegedly highlighted concerns about Parliament’s haste in declaring the Kpandai seat vacant while court processes were still pending.
The Minority has therefore called for a review of Parliamentary procedures to ensure that “notifications of vacancy are not issued while appeals and applications for stay are pending.”
Meanwhile, the apex court’s decision has been hailed as a victory for the people of Kpandai and a reaffirmation of the importance of due process and electoral integrity in Ghana’s democracy.
As a result, Mr Mathew Nyindam, the New Patriotic Party Member of Parliament for Kpandai, is expected to return to his seat in Parliament when the House resumes sitting on Tuesday, February 3, 2026.
